Kashmir is bleeding since 22 years it is not that solutions are not there but those who are in power there career depends on keeping this pot simmering that includes all the people in power on both side of border also separatist in the valley and religious dalals who use religion as a tool to exploit masses emotions. In Kashmiriyet culture there is no scope of religion fundamentalist.
Historical Perspective : At the time of Independence the way Britisher's handed over India which was rejected at face by Nehru but Sardar who was truly architect of modern India said to Nehru let them go we will sort out the matter ourselves. Britishers while leaving India gave legacy of divided India which suited them as India would not emerge as threat to their global supremacy. First they divided India on religious ground history has proved that country cannot be bound on religious ground otherwise Bangladesh would not have been created for that matter Pakistan being an Islamic country and that too small but still there are voices of separatism coming from Baluchistan and PoK. Secondly they gave Independence to 500 odds puppets Princely states which were remotely administered by the Britishers with the rider either to join India or Pakistan or remain independent and an accession treaty document was legal document the authorized signatory were only First Governor General Lord Mount Batton and respective Raja/Maharaja was created to annexe all princely states . As 500 odd princely realized the writing on the wall that this was end of Imperialism as well as Monarchy so they were persuaded by Sardar Patel to sign the accession treaty. Only Three states did not sign initally were J&K, Hyderabad and Junagadh however we will confine to only J&K which is topic of discussion. Initially Maharaja of J&K refused to sign accession treaty but opted for Independence which did not go well with Jinnah and he sent warrior tribal under leadership of Pakistan Army commanders to attack J&K so Maharaja fled to Jammu requested Nehru to send army which Nehru refused and asked him to sign first accession treaty which he did and then Nehru sent army and was in successful in driving away the raiders from Srinagar but against the advice of Sardar Patel he went to UN then UN intervened and ordered ceasefire which became LoC since last 65 years and under UN resolution it was passed that Pakistan should withdraw forces to International Border to enable Pleb site to take place. However Pakistan did not withdrew its forces also later on signed Shimla agreement in which was mentioned to solve all outstanding issues bilaterally so for practical purpose UN resolution has become dead as dodo. So any solution of J&K has to come between two countries no third country has got any scope to intervene.
What do people of J&K want? Kashmir is not a monolith consisting of one community with one language and with one religion but Coloradan of mixture of different races, communities with different languages, culture race but predominantly religion is Islam but which has come since last 1000 years before that predominantly it was Hinduism and Buddhism so the ethnic minority of J&K are very few in numbers as compared to Muslim but they are true sons of soil as many Muslims migrated to J&K over the period of time so also Hindus migrated over other place to escape the religious persecution of raiding invaders since they refused to get converted to Islam. However there is no consensus among all stake holders about future of J&K there are mainly three camps of J&K one is for Independence other is for merger with Pakistan and third is for India. However on PoK side there is vertical divide among people some want complete Independence and other want to merge with Pakistan.
Why merger of whole of J&K with Pakistan is not feasible. Kashmiri minorities are not comfortable with the constitution of Pakistan as minorities are not treated well in Pakistan also is an Islamic state where as under constitution of India minorities are given special privileges also there is no religion of State in India
Why Independent J&K is not feasible. Jammu and Kashmir is a land lock country totally dependent for basic necessity for outside world even for the rice which is staple food of Kashmiri as land they occupy cannot feed so many mouths so rice has to be imported . People do say water is main resource but forgetting that water is resource of not one country but of humanity at large would Pakistan allow to create dams on rivers which would effect them down stream. Historically even though India fought 3 wars but she did not use water as weapon and water sharing agreement survived all the roller coaster ride of 65 years of tumultuous journey of neighborly relationship. Also a known devil is better than unknown angel how do advocates of Independent J&K assure that their will not be a political instability or for that matter a tin pot dictator does not hijack whole country as in large country there are slim chances as there is in built check and balances and also it would be difficult for a single dictator to rule over a big country but small country it is possible. Also advocates of Independent J&K cannot wish away both India and Pakistan. History has proved a partition greatest blunder do you think in present day context where borders are becoming irrelevant due to advent of Internet you want to create another partition and face all the consequences which were faced in 1947 . ROAD MAP FOR ULTIMATE SOLUTION TO JAMMU & KASHMIR:- The solution to Kashmir should be based on practical ground situation also keeping in mind the common man whose priority is a peaceful co-existence which consequently will lead to prosperity in keeping those conditions I propose to make LoC as international border and make Union of Jammu & Kashmir and citizens of this union will be descendents of sons of soil as on 1947 and options to be given to all citizens to choose citizenship either of India or Pakistan also have freedom of movement within this union of J&K. In this way it will take care of all sections of society those who want to stay with India or who want Islamic state of Pakistan and still will be able to move freely within the union.
